Railroad/FELA  Accidents

Railroads have a duty to exercise reasonable care in the operation of their trains and in making crossings safe.  This may require proceeding at reasonable speeds in light of load and weather conditions, checking to make certain passengers enter and exit the train safely, providing gates, lights or other warnings to motorists.  Accidents that result due to the negligence of railroads for these occurrences and others, generally result in severe injuries or death.

Separately, when a railroad worker is injured on the job, the right to compensation is governed by a Federal law known as the Federal Employers' Liability Act, or FELA. To recover under the FELA, one must establish that the railroad failed to provide a reasonably safe place to work. The FELA, was intended to provide injured workers and their families with fair and manageable compensation for injuries.
